PROPERTY CONVEYANCING.

Make an appointment with us before (or, at the latest, as soon as) you have found the property you want to buy - and before you have signed anything with either the estate agent or the seller. As with any property purchase, it is essential to engage the Services of a qualified Solicitor or Lawyer. We provide a comprehensive conveyancing service and we ensure that all facets of the transaction are carried out strictly in accordance with Spanish Law.

ANNUAL TAXES.
Many people assume that if they own a holiday home in Spain they are not liable for Spanish taxes. WRONG!!! Non-Resident property owners ARE liable for 3 annual taxes.
SPANISH WILLS.
We prepare Spanish Wills for clients owning property in Spain. Whether you are Non-Resident or Resident, it is important to have a separate Will, prepared and registered in Spain, covering just your Spanish assets.
PROBATE AND INHERITANCE.
"Inheritance" is governed by the National law of the deceased person (the signatory of the Will). For example, if you are British citizen, you are covered by British Law - which respects the right of a British citizen to leave his/her assets to anyone of his/her own choice without any imposed obligation or limitation. (This is completely different for a Spanish citizen who, under Spanish Law, is obliged to leave a minimum percentage of their assets to their descendants).
NIE NUMBER.
All foreigners with any kind of fiscal (tax) obligations here in Spain (eg when buying property) are required to obtain a foreigner's identity number, called an NIE (Número de Identificación de Extranjero), which identifies you to the Spanish tax authorities. NIE numbers are issued by the Foreigners' Department of the National Police.
POWER OF ATTORNEY.
Called a "poder" in Spanish, a Power of Attorney is a convenient and commonly used way of finalising transactions in Spain by authorising a trusted representative, to sign relevant documents on your behalf.
LEGAL TRANSLATIONS.
All documents brought from a foreign country to be used before a Spanish Public Notary or any other public Authority must be legally translated by a recognised official translator.

SPANISH RESIDENCY.
The regulations and requirements for Residencia are constantly being changed to make the process easier for EU citizens. We have listed below the requirements as at 1 March 2008, but please check with us when you come for an appointment to see if changes have since been introduced.
DOCUMENTATION. LEGISLATION - APOSTILLE
All documents issued by a forenger department must be duly validated according to the correspondent legalisation procedure within the country where the document has been produced.
